1. Agreement to Terms

By accessing or using premiumroast.coffee ("the Site") or any services provided by MK153 Inc, doing business as PremiumRoast.Coffee ("we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Site.

2. Description of Services

PremiumRoast.Coffee is a directory of independent specialty coffee roasters, cafes, and wholesalers. The Site allows visitors to browse listings, save favorites, submit new businesses, and claim existing listings. We do not sell coffee or represent any listed business.

3. Use of the Site

You agree to use the Site only for lawful purposes. You may not:

  • Use the Site in any way that violates applicable laws or regulations.
  • Scrape, bulk-download, or systematically collect listing data without prior written permission.
  • Submit false, misleading, or inaccurate listing information.
  • Submit chain, franchise, or corporate-owned locations.
  • Use automated tools (bots, scrapers) to access the Site without prior written permission.
  • Impersonate any person, business, or entity.
  • Interfere with or disrupt the proper functioning of the Site.

4. User Accounts

You may create a free account using your email address and a magic link. By creating an account you agree to:

  • Provide an accurate email address and keep it up to date.
  • Maintain the confidentiality of your account and notify us immediately of any unauthorized access.
  • Be responsible for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that violate these Terms, at our sole discretion.

5. Business Listings and Submissions

Listing data is compiled primarily from OpenStreetMap and enriched via roaster websites and Google Places. We strive for accuracy but cannot guarantee all information is current or complete. Business owners may submit corrections or claim their listing via the Submit page.

By submitting a listing or correction, you represent that the information is accurate and that you have authority to submit it on behalf of the business. We reserve the right to review, edit, or remove any listing at our sole discretion.

Independent businesses only. PremiumRoast.Coffee lists independent coffee roasters and cafes only. Chain locations, franchises, and corporate-owned outlets are not eligible. We reserve the right to determine eligibility.

6. Intellectual Property

All content on the Site, including design, code, editorial content, and the arrangement thereof, is the property of MK153 Inc or its licensors and is protected by intellectual property laws. Listing data is compiled from public sources (OpenStreetMap, business websites) and community contributions.

You may not reproduce, distribute, or create derivative works from Site content without our prior written consent.

7. Third-Party Services

The Site integrates with third-party platforms including Supabase (authentication and database), Vercel (hosting), Google Maps and Google Places (mapping and listing enrichment), and Google AdSense (advertising). Your use of those services is subject to their respective terms and conditions. We are not responsible for the availability, accuracy, or practices of third-party services.

8. Advertising

The Site displays advertisements served by Google AdSense. Ad content is determined by Google and is subject to Google's advertising policies. We do not endorse any advertised product or service.

9. Disclaimer of Warranties

THE SITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT LISTING INFORMATION IS ACCURATE OR CURRENT, THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT YOUR EXPERIENCE AT ANY LISTED ESTABLISHMENT WILL MEET YOUR EXPECTATIONS.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY CALIFORNIA LAW, MK153 INC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE, INCLUDING BUT NOT LIMITED TO RELIANCE ON LISTING INFORMATION, BUSINESS CLOSURES, INACCURATE HOURS OR ADDRESSES, OR YOUR EXPERIENCE AT A LISTED BUSINESS.

11. Indemnification

You agree to indemnify, defend, and hold harmless MK153 Inc and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Site, your violation of these Terms, or your violation of any rights of a third party.

12. Dispute Resolution

If a dispute arises, you agree to first attempt to resolve it informally by contacting us at support@premiumroast.coffee. If unresolved within 30 days, either party may pursue binding arbitration administered by JAMS in accordance with its Streamlined Arbitration Rules, held in California.

Class action waiver: Any dispute resolution will be conducted only on an individual basis and not in a class, consolidated, or representative action.

13. Termination

We may suspend or terminate your access to the Site at any time, with or without cause and with or without notice. Provisions that by their nature should survive termination — including limitation of liability, indemnification, and dispute resolution — will continue to apply.

14. Changes to Terms

We may modify these Terms at any time. We will post the updated Terms on this page with a new "Last updated" date. Continued use of the Site after changes constitutes acceptance.

15. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law provisions. Any legal proceedings not subject to arbitration shall be brought in the state or federal courts located in California.

16. Severability

If any provision of these Terms is found unenforceable or invalid, that provision shall be limited to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
